Buckley Amendment Glossary

The 1974 U.S. law better known as FERPA; foundational to educational privacy obligations around student records.

The Buckley Amendment is the common historical name for the Family Educational Rights and Privacy Act of 1974, or FERPA. It established student rights over educational records and placed privacy obligations on institutions that receive federal funds.

For AI systems in education, the Buckley Amendment matters because the legal object is not AI as such. The legal object is the student record, the institution’s handling of it, and whether protected information is disclosed to unauthorised parties or vendors without proper basis. A chatbot becomes legally interesting when student data passes through it.
